All in a day's words in politics


Some phrases have become jargon for lawmakers. Many have been overused, and in most cases misused, by this category of people.


Ten most incredible remarks by our (or any other) politicians:


1. Playing politicsOne politician accusing another politician of “playing politics”. If politicians are not playing politics, then what are they supposed to be doing? We expect politicians to, well, play politics and to engage in politicking. That’s their job and that’s the skill they’ve honed. Can we imagine, say, a footballer accusing another of the same act – “he is only playing football.” It’s bizarre when politicians point fingers at their counterparts for playing politics, often with negative connotations, as it amounts to accusing their reflection in the mirror.

2. Serving the people and country
Every politician in any given country says the same thing. They are supposedly only interested in serving the people, the country, religion, race, pets, families and everything they can think of – except themselves! And we are expected to believe that that’s their noble cause and that they don’t have any ulterior ambitions. Yet, they will spend their entire time and resources kicking, back-stabbing, bad-mouthing and clawing their way to the top! Of course, we will duly be told that they can serve the people “better and effectively” the higher they reach, all in the name of the people’s benefit, of course.

3. I will “take note” of the proposal –
Which means the politician will do nothing. In fact, if your staff or colleague spouts the same phrase, it only amounts to the person not deserving a pay rise. Lazy bones syndrome? Highly likely! It’s almost an expression of inertness. Amazingly, it has now become the standard “tactical response” used by politicians to answer fellow Members of Parliament on the opposite bench during Question Time.

4. I “will study” the proposal
This gives the above a run for its money.

The same disinterested, non-committal reply, aka, “I am doing nothing about it”. This merely amounts to, “We will form a sub-committee/a committee/a task force/action committee to study the matter and a report will be submitted to another committee, which will then deliberate the findings.” In short – nothing happens for a while, or probably in the end, nothing happens at all.

5. “I have been misquoted by the press”
This means the politician has screwed up by putting his foot in his mouth (foot-in-mouth disease?), and the only way to get out of the mess, is well, to deny having said it all together.

And if he did say it, then blame the media for taking it “out of context”. And in their minds, this equals: the media has an ulterior motive; the media is biased; the media has an agenda; the media creates fake news.

Well, if the media produces audio or visual evidence to prove the politician’s folly with the said contentious remarks, then the standard operating procedure would likely be “well, I did say it, but I did not mean it THAT way,” or “you did not quite understand what I said”.

6. Fake news
It has frighteningly and sneakily crept its way into Malaysian politics from the United States, President Donald Trump its greatest purveyor. The fake news accusation is a good tactical move to defend illogical/embarrassing situations created by politicians, and used to near perfection by Trump.

It is just as handy for scatterbrain politicians.

7. Trust me
When a politician requests this faith, you know you should believe in your own instincts and scurry in the opposite direction. But it has to be the most overused and, consequently, misused phrase by politicians everywhere, perhaps perfected by North Korean leader Kim Jong-un, who doesn’t even have to worry about standing for elections!

8. Dementia
It’s a disease all politicians should contract if they wish to survive long in the merciless business of politics. You are expected to lose your memory of past actions against your opponents, if it means, you are now required to swallow your indignation to forge a new political partnership.

“What? I took action against you? Did I? It can’t be, it’s someone else who did it. Not me. If I did, well, I hope to pardon you soon.” Sound familiar?

9. The opposition is only interested in toppling us
Well, that’s exactly their job scope, isn’t it ... to take over from the present administration? If they are not interested in toppling existing governments, then aren’t they wasting their time in the opposite side of the camp?

10.
There are no permanent enemies, only common interests – In Malaysia, our politicians have turned this into a near artform, hopping in and out of bed so much so voters end up losing track of the number of strange bedfellows.

Let’s not even get into the pillows and strange dreams, or nightmares that have been created for getting in the same sack. One day, a party is accusing another of being an “infidel”, and the next, it is actually working with “infidels”. Almost predictably, after that, it is seen to be friendly with the same party that it has been crossing swords with for decades.

Meanwhile, divorces are announced for the break up with the infidels, yet, the desire to stay in the same house remains, because, well, the rakyat needs to be served.

That’s not all, and this one is even more incredulous – a leader once threw his opponents into the slammer for all kinds of offences, ranging from threatening internal security to sexual perversion, but in the very next instance, touted his once greatest enemy as the leader-in-waiting and probably gave him a BFF status on his FB. Of course, our voters are expected to subscribe to all of this and believe it’s for their own good.

For the love of Datuk titles

IF there’s one Malaysian practice that needs reviewing, it has to be this – the long salutations, thanks to the titles of prominent individuals, at the start of speeches during functions.

I can never understand why addressing the audience as “distinguished guests” isn’t good enough. Surely, the audience would be happy to be called distinguished. Or maybe even just “Ladies and Gentlemen”.

Malaysians, however, have to cringe and listen to speakers formally addressing each and every titled person at functions.

We begin with “Tan Sri Tan Sri, Puan Sri Puan Sri, Datuk Seri Datuk Seri, Datin Seri Datin Seri, Datuk Datuk, Datin Datin and distinguished guests”.

And this before the speaker even begins honouring the more important guests by actually naming them one by one, along with their long titles, honorifics and designations.

All these can take up to 10 minutes before the person finally gets to the actual speech.

Welcome to Malaysia. This is another practice which reflects our obsession with formality and titles. It may sound medieval and strange to visitors to Malaysia but this is the done thing here, presumably because some ego-inflated titled individual got offended when his title was not mentioned in a speech.

But alas, the whole thing has become a mockery of sorts. The intention, good as it may be, is actually offensive to the other equally important guests, those with no titles.

They have ended up at the bottom of the pack, in the category of “tuan tuan dan puan puan” or “ladies and gentlemen.” To put it in perspective, without us realising, this is like the category of “dan lain-lain” or “others” which many Malaysians have stood up against.

One would understand it if such a practice is carried out in a palace where protocols are strictly adhered to but surely, not in ordinary functions?

For one, it takes up precious time when most of us just want to get on with the business of the day or in many instances, get on with the dinner. Please, at 8.30pm, most of us are hungry already.

Many times, guests are made to wait, especially when the guest of honour arrives late. By the time the VIP gets there, and thanks to the long and winding speeches, dinner is finally served – at 9.30pm or 10pm.

One wonders why the VIP has to be ushered into a holding room – another peculiar Malaysian practice – before he makes his grand entrance into the ballroom.

I have attended enough events in Britain and the United States, where VIPs would just walk straight into the function hall without any fanfare.

In London, then mayor Boris Johnson cycled to the opening of a property development site and in Sydney, the mayor parked his car a short distance away and walked to the venue!

He introduced himself to his (very) surprised Malaysian audience – and of course, there was no entourage fussing around him to make him look important, another one of our local standard operating procedure.

To be fair, not all of our VIPs are spoilt silly. Sometimes, it is their officers who make a fuss over these formal arrangements to the event’s host.

Those in the royal circles, who have a career in protocol, push even harder – even when the heads of states themselves do not demand it. His Highness Sultan Sharafuddin Idris Shah of Selangor does not even allow waiters to get the napkins ready for him before his meals, insisting on doing it himself.

The Ruler drives his own car often to functions and tells his police motorcade not to put the sirens on because to him, there was no need to put on such a display of importance.

The Sultan of Johor, Sultan Ibrahim Ibni Almarhum Sultan Iskandar, sportingly poses for selfies with his subjects often, sending his security and protocol officers into a frenzy many times.

And most of the time, he drives his car himself. Often, he makes a stop and have a meal at roadside shops, without prior notice. For breakfast, he goes to a mamak restaurant for roti canai quite regularly, again without fuss or advance notice.

At the Cabinet level, Datuk Mustapa Mohamed, the Minister of International Trade and Industry, is certainly the most down-to-earth minister from Umno.

Travellers taking the ERL from KL Sentral to KLIA often see Mustapa travelling alone or taking a flight on Economy Class home to Kelantan. He does not see the need to shout about it or have his officers post a picture on Instagram to get publicity.

Permodalan Nasional Bhd chairman Tan Sri Abdul Wahid Omar insisted on moving around on his own, without the need for bodyguards, when he was in charge of the Economic Planning Unit (EPU). The same can be said of Datuk Seri Idris Jala, who is now chief executive officer of the Performance Management and Delivery Unit (Pemandu).

Perhaps their non-political background helps but having said that, there are corporate figures who are even more status-conscious than politicians.

And seriously, what do Malaysian VIPs do with gifts or “token of appreciation” items presented to them at the end of every function? Yep, they are probably gathering dust in some room filled to the brim with other such items in Putrajaya.

At one time, there was a proposal that only a basket of fruits be given as it was more practical but it never got off the ground.

Likewise, this article will have no impact on the issue.

Malaysia is in danger of becoming a nation with the most number of decorated people


THIS has to be a record of some sort – a notorious gang of 60 hardened criminals including four low-level politicians with the titles of Datuk and a Datuk Seri, has been netted in a series of swoops.

The Gang 360 Devan gang, involved in murder, drug-pushing, luxury car theft and hijacking, has to be the gang with the most number of titled leaders.

Then, there is also the leader of the notorious Gang 24 – a Datuk Seri – who was among 22 men held in another spate of arrests.

Last December, a gang leader known as Datuk M or Datuk Muda was shot dead by his bodyguard while they were driving along the Penang Bridge. The Datuk was a detainee at the Simpang Renggam centre.

A day later, a video went viral showing a heavily tattooed man being violently beaten up by a group of men believed to be gangsters, at the late Datuk’s funeral.

Three days ago, there was a series of arrests by the Malaysian Anti-Corruption Agency (MACC) which saw a number of Datuks being arrested and charged.

If we hold the record of being the country which has the highest ratio of government servants, we may also soon be the country with the most number of titled people.

And if we are not careful, we could well be a country which has the most titled criminals.

The people being conferred a Datukship seem to be getting younger and some are surprisingly under 30 years old, which begs the question – what have these youngsters contributed to society to deserve such titles?

Last October, Singapore’s Straits Times carried prominently a news report of a teenager who purportedly became the youngest “Datuk” in the country.

“The image that went viral shows the apparent recipient of the title standing in a crowded waiting room while dressed in ceremonial attire with the caption reading: “Youngest Dato in Malaysia ... 19 years.”

The Malaysian media, which carried the news earlier, has not been able to verify the age of the person in the photo. And no one has denied the authenticity of the article, not even the person in the photo, who may actually be older than he looks.

Regardless of which state these titles are from, many Malaysians rightly deserve the recognition from the royal houses because of their community work, in various forms.

One or two states, especially Pahang, seem to be more generous in conferring awards while states like Selangor, Johor, Perak, Sarawak and Kelantan are more stringent in their selection.

The Selangor state constitution states that only a maximum of 40 Datuk titles can be conferred each year.

The Sultan of Selangor Sultan Sharafuddin Idris Shah has imposed stricter conditions – including the minimum age of 45 – for a person to be conferred the state’s Datukship, to limit the number of recipients and protect the image and dignity of the awards.

In the case of Johor, Sultan Ibrahim ibni Almarhum Sultan Iskandar has expressed his frustrations openly, saying sarcastically “that it has come to a point that if you throw a stone, it will hit a Datuk and when the stone rebounds, it will hit another Datuk”, to illustrate the point that Malaysia is in danger of becoming a nation with the most number of decorated people.

While the increasing number of people with the Datuk title has long been a contentious issue, what Malaysians are concerned about is the number of such titled persons being involved in crime.

Pictures of a certain Datuk with a visible tattoo on his hand, purportedly depicting his gang allegiance, have long gone viral on social media.

Malaysians are asking whether royal houses submitted the names of potential recipients to the police for vetting before conferring them with titles. This is a practice of the Sultan of Selangor. If that were the case with every state, criminals would not have been awarded.

I have complete faith in the ability of our police force. They will carry out their duty of checking the background of such people if asked to do so.

But what is taking place now in Malaysia is also a reflection of our people’s obsession with titles, honorifics and even fake academic titles.

Our former deputy prime minister, the late Tun Ghafar Baba, was just plain Encik, until the day he retired from office.

In Tunku Abdul Rahman’s first Cabinet, after we achieved independence, only five of 15 ministers were made Datuks.

The finance minister at the time, Tan Siew Sin, only held the title of Justice of Peace – which is recognised in Commonwealth countries.

Penang’s first Chief Minister, the late Wong Pow Nee, had no title until he retired, after which he was made Tan Sri. Another was the late Gerakan president Dr Lim Chong Eu who only became Tun upon retirement.

In short, things were pretty simple back then, with proper methodology when it came to conferring decorations, medals and titles. But not today.

There are now so many variations of the Datuk titles – Datuk Seri, Datuk Sri, Datuk Paduka, Dato’, Datuk Wira and Datuk Patinggi (depending on the states) – it has become confusing, even to members of the media.

There are now calls from some titled people that the press should use their titles accurately. I can only imagine the number of corrections the media has to deal with if mistakes are made and some snooty individual gets upset.

In the 1970s, the media decided to standardise how these title holders should be addressed by calling them all “Datuk”. The press also decided to call the Datuk Sri from Pahang “Datuk Seri”.

It is just impossible to check every single title or pre-fix when naming a person.

The reporter does not ask the police where the criminal suspect got his Datukship. Neither can we ask the Datuk criminal as he is being led to the courts in handcuffs, “Where is your Datukship from, Datuk” ?

Besides Brunei, the Malaysian press must be the only one that includes the titles of individuals. Well, there is the British media but they only address those who are knighted with the title “Sir”.

The royalty shouldn’t be the only party blamed for the increasing number of Datuks. Malaysians are willing to go to all lengths to buy the titles, even from bogus sources.

But the titles must not be bestowed on any one with a criminal record or it makes a mockery of this honour.

"If you have no power, you cannot abuse it. Civil servants have a lot more power than their political masters and ministers"

To keep graft in check, politicians should not be appointed to run government-linked companies, said Malaysian Anti-Corruption Commission advisory board chairman Tunku Abdul Aziz Tunku Ibrahim (pic).

He said politicians holding GLC positions may face conflict of interest leading to abuse of power and responsibility.

In an interview with Bernama, he said: "Many appointments are made for political reasons. If you are appointed to a position with unanimous power, there are decisions you have to make on a daily basis, weekly, monthly and whatever.

"And in making these decisions, there will be some demands made on you because of your connections, your relatives, your friends and also your cronies."

Tunku Abdul Aziz said this trend of abusing power because of conflict of interest has been happening since long ago, and may be stopped if the appointment for a top post in a GLC was conducted with "proper selection and screening".

Tunku Abdul Aziz said the selection process must include going through the candidate's background and track record.

He said there were always people out there who wanted special treatment, to have the advantage over their competitors.

"They don't care how it is done (as long as they get the job)... This is where corruption starts."

Tunku Abdul Aziz said that proper recruitment procedures and techniques could help achieve transparency and accountability, which are essential for top management.

"We can make corruption unprofitable business by making it more difficult to put your hand in the till."

He believes that corruption is now taking place at the operating level.

"Ministers cannot sign or award contracts. But directors in some departments can do it. This is where abuse of power takes place," he said.

"If you have no power, you cannot abuse it. Civil servants have a lot more power than their political masters and ministers (in awarding contracts)," he said.

He noted that the Malaysian Anti-Corruption Commission was now catching a lot more "big fish" than before the appointment of Datuk Dzulkifli Ahmad as the new head in July last year.

Tunku Abdul Aziz said MACC was a dedicated highly professional team focusing on the root causes of corruption while catching the crooks.

Time to trim the civil service


 FINALLY, the Government has itself described the civil service as bloated.

To his credit, Second Finance Minister Datuk Johari Abdul Ghani openly and honestly stated that the civil service, although bloated, will not be reduced but will instead be made to multi-task to improve productivity. This statement is serious but also worrisome.

We now have one civil servant serving 19.37 people. The ratio is 1:110 for Indonesia, 1:108 for China, and 1:50 for South Korea. We won’t compare ourselves to the low ratio of 1:71.4 in Singapore because it’s a small island with hardly any rural population.

But why is our civil service so bloated? Firstly, we recruited rapidly to give jobs to the boys when the output from the education system expanded. We even had an “Isi Penuh” programme at one time. That is we rushed to create jobs and filled them fast!

Secondly, unlike the private sector, we rarely retrench staff even in bad times. We hardly sack anyone for inefficiency and even wastage of public funds.

Thirdly, the civil service has become a sacred cow that has to be handled gingerly for fear of reaction against the federal and state governments at the ballot box!

Life is relatively comfortable especially at the lower levels of the civil service. Salaries are better than before, pensions are secure, health provisions are generous, and the drive to be more productive is soft. In fact, there is now a strong manja-manja attitude towards civil servants.

The demand to join the civil service is high but the supply of jobs is slowing down considerably.

The Government should decide to reduce the size of the civil service to prevent the strain on the budget deficits, especially in the future.

Salary and pension bills are going up whereas productivity is not publicly perceived to be improving. Those who deal with civil servants often tell us more about the undue delays, corruption and “tidak apa” or lackadaisical attitude shown on the ground towards the public.

The Government should appoint a high-level task force, if not a royal commission, to examine ways and means of trimming the civil service to an efficient and reasonable size.

To start with, the Government should revise its stand on not reducing “the 1.6 million strong bloated civil service.” If it finds it difficult to reduce the civil service, then please freeze recruitment or make it more sparing and definitely more selective. Please go for more quality rather than quantity!

The civil service is huge because the public sector has been designed to be inordinately large. This has evolved because the private sector has been denied and deprived of greater opportunities to serve the public.

There are many government services, facilities and works and supplies that can be provided more efficiently by the business sector. In fact, this could be the way forward for more bumiputra contractors and other races to participate more actively and competitively to serve our society better.

The cost of maintaining the civil service, at RM74bil in 2016 for salaries and allowances, is not sustainable.

The pension bill of RM19bil per annum, without any contribution to the GDP by retirees, is also unbearable in the longer term. At the same time, according to Johari, revenue from palm oil and other commodities have been falling drastically. So where do we go from here?

It is basic economic and financial logic that we cannot afford to cope with rising salary expenditure and lower revenue. It is much more difficult to raise revenue than to cut expenditure.

The Government has said that our fundamentals are strong. Indeed, they are reasonably healthy at this time. But at this rate of a growing civil service that is now acknowledged as bloated, we cannot afford to assume that the economic and financial fundamentals can continue to be strong for much longer.

My appeal then is for Government to more actively seek to reduce the size of the civil service and to act without undue delay. Our good economic fundamentals are being seriously threatened and we must preserve and protect them from further risks.

IN a recent interview with a vernacular newspaper, Second Finance Minister Datuk Johari Abdul Ghani brought up a matter that is seldom highlighted publicly – the size of the Malaysian public sector.

He said the country’s 1.6 million government employees formed “the world’s largest proportion of civil service”.

With a population of 31 million, Malaysia has a ratio of one civil servant to almost 20 people.

To compare, the news report cited corresponding figures for several other countries: Singapore (1 to 71 people), Indonesia (1:110), South Korea (1:50), China (1:108), Japan (1:28), Russia (1:84) and Britain (1:118).

Johari was making the point that a major challenge for the Government was the rising costs of running the public service system.

This is particularly tough when there is a decline in the taxes and other receipts collected from the oil and gas and palm oil industries.

However, he added that there were no plans to reduce the civil service head count.

The minister has won praise for bringing attention to an issue that many have long felt deserves public awareness and discussion.

Emoluments are by far the biggest component of the Government’s operating expenditure, and that cost has kept expanding.

Back in 2006, emoluments totalling RM28.5bil made up 26.5% of the operating expenditure. A decade later, the percentage is estimated to be 35.7%. To pay its employees this year, the Government has allocated RM77.4bil, which is 36% of the budgeted operating expenditure.

And let us not forget the retired civil servants. According to the Public Services Department, there were 739,000 public service pensioners in 2015, and every year, 23,000 people join this group.

In 2010, the Government spent RM11.5bil on pensions and gratuities, accounting for 7.6% of the operating expenditure. In the Budget 2017, retirement charges will come to RM21.8bil, about 10% of operating expenditure.

Although Johari did not appear to use the phrase in the interview, others were quick to talk about the “bloated civil service”.

It should be pointed out that measuring and comparing the sizes of the public sector can be tricky and misleading. There are different ways of defining a civil servant. And the width and depth of a public service system is very much determined by the country’s prosperity and policies.

The Organisation for Economic Cooperation and Development looks at public sector employment as a percentage of total employment. In 2013, the average among its members was slightly above 19%.

In Malaysia, civil servants represent 10.8% of our labour force. Perhaps, the public sector is not bloated after all.

On the other hand, we must bear in mind that the number of government employees is growing faster than the country’s labour force.

But we cannot discuss quantity and ignore quality. The issue here is not about how large our public service system is; it is whether the system is larger than necessary.

No matter how big, the numbers make sense if they yield excellent results and lead to robust revenue growth.

At a time when the Government is pushing hard in areas such as innovation, productivity and good governance, the civil service ought to lead by example.

There are already ongoing efforts to transform public service in Malaysia and surely the hope is that these initiatives will result in greater transparency and accountability, enhanced competitiveness, and a high-performance culture,

What is also absolutely clear to us is that the Government’s financial obligations are increasingly heavy, and much of this has to do with the emoluments and pensions it pays.

It is realistic to expect the Government to be more prudent in its hiring of new employees. It cannot afford to be the country’s default employer and young people are wrong to blame the Government if there are no civil service vacancies for them to fill.

Every year $1 trillion is paid in bribes while an estimated $2.6 trillion are stolen annually through corruption – a sum equivalent to more than 5 per cent of the global GDP. In developing countries, according to the United Nations Development Programme, funds lost to corruption are estimated at 10 times the amount of official development assistance.

Corruption is a serious crime that can undermine social and economic development in all societies. No country, region or community is immune. This year UNODC and UNDP have developed a joint global campaign, focusing on how corruption affects education, health, justice, democracy, prosperity and development.

The 2016 joint international campaign focuses on corruption as one of the biggest impediments to achieving the Sustainable Development Goals (SDGs).

KUALA LUMPUR: The Malaysian Anti-Corruption Commission (MACC) has urged the public to work with the agency to curb graft and make the country a corruption-free nation within three years.

Its chief commissioner Datuk Dzulkifli Ahmad said efforts to combat corruption and abuse of power did not lie exclusively with MACC and should be supported by the society at large.

“Firstly, we must hate corruption. Secondly, we must reject corruption and thirdly, the people must cooperate with MACC to fight corruption and abuse of power,” he told pressmen yesterday during a MACC walkabout session held in conjunction with International Anti-Corruption Day.

Dzulkifli said he appreciated the support given by people regardless of age, race and religion because “corruption is detrimental to all layers of society”.

The MACC team and NGO volunteers distributed leaflets to RapidKL LRT passengers at 15 stations during the walkabout.

Among others, the leaflets stated that corrupt practices also included those who offered bribes to officials or made false claims for work or services done.

“If one does not report a corrupt practice, one is passively encouraging corruption and allowing the corrupt to walk free,” it said.

“Tax money and resources that are meant to build the country are being wasted or siphoned for personal gain, and the quality of goods and services provided would be poor.”

In Kota Baru, Bernama reported that at least three high-profile cases with losses worth millions of ringgit were being probed by Kelantan MACC.

State director Datuk Moh Samsudin Yusof said investigations were still in the early stages involving organisations, individuals and senior government officials.

“The cases are related to tampering with government revenue, hindering revenue collection, incurring government losses and carrying out development project without following the rules,” he told reporters after opening the state-level International Anti-Corruption Day celebration yesterday.

A total of 31 investigation papers have been opened in relation to complaints of corruption in the state this year.

Commission urges public to be proactive


PUTRAJAYA: Drawing parallel to the Liverpool FC anthem You’ll Never Walk Alone, the Malaysian Anti-Corruption Commission (MACC) is calling upon the public to play a proactive role and work closely with them to nip all forms of corruption in the bud.

In saying that the fight against corruption was a never ending task, MACC deputy chief commissioner (prevention) Datuk Shamshun Baharin Mohd Jamil (pic) said the anti-graft body would continue to carry out its duties in accordance with the three key pillars – free, transparent and professional.

“Let me put on record that as long as there is a report, we will probe the alleged wrongdoer, and this includes politicians.

“We don’t need to refer to others or wait for the green light to start an investigation.

“As far as we are concerned, we will go after any shark or small fry in the public or private sector, regardless of their background, position or social status.

“Our target over the next three years is to clean up the public sector, particularly those involving enforcement authorities, local councils and government-linked companies,” he said in an interview in conjunction with the International Anti-Corruption Day today.

Shamshun Baharin said while it was impossible to totally eradicate corruption, the MACC would do all it could to cut down such unhealthy practices.

“Frankly, there is not a single country in the world with zero corruption.

“But our continuous anti-graft efforts have started to bear fruit and get strong public support.

“We have also received international recognition. Some countries have requested to sign MoUs to share our expertise,” he said, citing Bhutan, Bangladesh, Iran, Pakistan and Mongolia.

Shamshun Baharin said battling public perception was still its biggest challenge, and that the MACC was also trying hard to convince people to give information and lodge reports.

“Whistleblowers are worried about personal safety and that of their family members, so they choose to remain quiet.

“But this will permit wrongdoers to continue with their wicked ways for personal gain,” he said, adding that the Witness Protection Act 2009 and the Whistleblower Protection Act 2010 could be used to protect the identity of informers and keep them safe.

Shamshun Baharin said public expectation was high and that the people were scrutinising all cases, especially those involving big names and seizures, and alleging that the MACC was being selective.

“But they fail to realise that we only have investigative powers.

“Prosecution is solely in the hands of the Attorney-General while the courts decide on the verdict,” he said.

Easy to catch the corrupt if with a catch-all clause to tighten anti-corruption laws

"It shall be an offence of any person to lead a lifestyle or possess assets which are disproportionate to his or her declared income."


UNTIL October 2006, few people outside political circles knew him. He rose from an obscure railway gatekeeper staying in a one-room quarters at the railway crossing where he was required to raise the barriers to allow vehicular traffic to flow after the trains had passed by.

By the time theSun front-paged the story on his "meteoric rise" and his "palace" which he had built on land meant for low-cost housing, his positions in the party and as a state assemblyman were hanging by a thread.

The late Zakaria Mat Deros (God bless his soul) gained notoriety for building his 16-bedroom house without even submitting building plans. He had not paid the assessment for 12 years on two low-cost units previously occupied by his large family.

So, last week nostalgia came back when the Ikan Bakar man took journalists on a helicopter ride to show the "palace" of a politician – a divisional youth leader in the opposition.

Preceding this, Crime Watch supremo alleged that the inspector-general of police had himself built yet another "palace" in Mantin.

The accusers in both instances asked the relevant authorities to investigate them alleging that they must explain how they got the money to acquire such property.

This prompted a Facebook user to suggest in jest that he wants partners to start a helicopter service for aerial tours to pick out mansions of politicians. In banter, I offered my services and reasoned that I had a good track record.

Over the years, I have come across several ordinary cikgu who became millionaires after their foray into politics. There are scores of "politically connected people" (to borrow a term that has now become the new mantra for banks and bankers) living in similar luxury.

There are also good people who stepped into the dark side unable to resist their own temptation or that of their wives to lead different lifestyles and keep up with the Joneses. There are some female golfers who even have golf bags to match the colour of their attire.

Then there's the average man who is turned over because he can't make ends meet on his meagre salary and many dependants. But the law does not differentiate between the poor, the middle class and the rich. Perhaps, such a factor could be pleaded in mitigation for a lighter sentence.

I have been repeatedly told that being rich or wealthy does not constitute an offence.

An offence only takes place if the money is obtained illegally – corruption, money laundering, criminal breach of trust, cheating and the like.

Asking the authorities to investigate the source of the money is dangerous territory full of mine fields and cluster bombs.

First of all, the Malaysian Anti-Corruption Commission (MACC) can only compel someone to declare his assets. Once the assets are declared, there is no offence.

Second, if he or she is caught with the cash or money in the bank, a non-acceptable explanation would lead to charges of money-laundering – NOT corruption; not getting assets through corruption; not getting money from illegal activities.

We had the perfect opportunity to put it right when former prime minister Tun Abdullah Ahmad Badawi promulgated the Malaysian Anti-Corruption Commission Act to replace the outdated Anti-Corruption Act towards the end of his tenure.

In the proposals was a clause which stated: "It shall be an offence of any person to lead a lifestyle or possess assets which are disproportionate to his or her declared income."

By the time this legislation was presented as a bill in Parliament, this clause had been removed from the original draft. We were then told that several "warlords" within the system opposed the clause because they themselves would have to account for their wealth!

So, instead of putting the onus on the official suspected of corruption to prove he earned the money legitimately, the prosecution has to prove that he had received a gratification. That is difficult because corruption is a victimless crime. Both giver and taker benefit and one usually will not squeal on the other.

In the absence of such legislation, the prosecution usually files money laundering charges. But the core issue of proving that he or she was a corrupt person through the legal process becomes almost impossible. In such circumstances, it leaves Joe Public's imagination to run wild as to the source of the wealth.

Under these circumstances, shouldn't that catch-all clause be re-visited with a view to tightening our anti-corruption laws? Hong Kong has been successful in its fight because such a clause in its legislation empowers officers from the Independent Commission Against Corruption to serve notice demanding explanations from suspected corrupt officials.

If they fail to provide a plausible or satisfactory account of their wealth, they are prosecuted. A few like-minded lawyer-friends had a discussion on this and came to the conclusion that if this clause is incorporated, our prisons would be overcrowded.
